Let's talk legal. Here are the terms, policies, and agreements that are important when using Wayshaping.

Terms of Service

These Terms of Service (“Terms”) set the terms and conditions that apply to your access and use of all Wayshaping products and services (together, the “Services”), and that are made available through our websites including but not limited to those located at wayshaping.com, as well as through any downloadable mobile applications—all of which will be referred to as the “Site.” 

In the Terms, “Wayshaping” or “we” refers to the business of James Cartwright (doing business as “Wayshaping”) and affiliates, and “you” refers to the individual using the Services and, if such individual is using the Services on behalf of an entity or organization, then such entity or organization (and each of your successors and assigns). The Services are intended for U.S. residents only and may include, but are not limited to:

  • access to digital media publications
  • email newsletters
  • storage of household information and personal preferences
  • storage of reminders
  • access to third-party rewards programs
  • community discussion forums

By using or accessing the Services you agree to the Terms, as updated from time to time in accordance with Section 8 below. Because Wayshaping provides a range of services, some of which are optional, we may ask you to review and accept supplemental terms that apply to your interaction with a specific Service.

To use some of the Services, you may need to provide information such as credit card or bank account numbers to third-party services, which Wayshaping uses. For more information regarding how we collect and use information in connection with our Services, see our Privacy Policy.

I. Site Content

The materials, information and content made available or displayed on the Site sent to you through the Services, and any derivative works thereof, whether made by us or you, (collectively, "Site Content") are proprietary to us or our licensors and should be considered our confidential information. Subject to these Terms, including any Supplemental Terms, we hereby grant you a limited, non-exclusive, non-transferable license to view, use, download and print the Site Content solely for your personal, informational, non-commercial and internal review and solely in accordance with these Terms.

You may not: 

  1. use the Site Content or any part thereof to develop products or technologies similar to the products of Wayshaping; 
  2. reproduce, republish, modify or alter the Site Content; 
  3. distribute or sell, rent, lease, license or otherwise make the Site Content available to others; or 
  4. otherwise remove any text, copyright or other proprietary notices contained in the Site Content. 

Any copy of the Site Content or portion thereof must include all copyright notices, information, and restrictions contained in, or attached to, any of the Site Content, and you must abide by the foregoing notices and restrictions. To request certain Site Content, you may be required to provide us with your contact information, including your email address. We may, in our sole discretion, then send you such Site Content in a format we determine in our sole discretion. You agree to only provide us with true, accurate, current and complete information in such a request. We reserve the right to reject your request and refuse to send you our Site Content. We are not responsible to ensure, and disclaim any responsibility for your ability to open, use or view the Site Content we send you pursuant to your request. As between you and us, we retain all right, title and interest in and to the Site Content, and all related intellectual property rights. We reserve all rights not granted in these Terms. You will immediately notify us in the event of any loss or unauthorized disclosure of any Site Content. Upon our written request, or your termination of these Terms, you must promptly delete or destroy all documents and other tangible materials representing any Site Content and all copies thereof. Different partners may use the functionality of their own application (“Third Party App”) to provide you with the Site Content. You agree that the entity providing that particular App is solely responsible for the Third Party App and not Wayshaping and that you shall look only to that entity to resolve any dispute regarding your use of that Third Party App, including any use of our Site Content. All offers, images, information, questions, comments, statements, and other content provided by the Third Party App (“Partner Content”) are owned by the entity providing such Partner Content. You agree that the provider of any Partner Content is solely responsible for such Partner Content and that you may be exposed to Partner Content that is offensive, indecent or objectionable to you, including questions related to political activities with which you may not agree.

II. Ownership

You understand and acknowledge that the software, code, proprietary methods and systems used to provide the Site are: 

  1. copyrighted by us and/or our licensors under United States and international copyright laws;
  2. subject to other intellectual property and proprietary rights and laws; and
  3. owned by us or our licensors. 

This software, proprietary methods, and systems may not be copied, modified, reproduced, republished, posted, transmitted, sold, offered for sale, or redistributed in any way without our prior written permission and the prior written permission of our applicable licensors. You must abide by all copyright notices, information, and restrictions contained in or attached to any of the technology. Nothing in the Agreement grants you any right to receive delivery of a copy or to obtain access to Wayshaping’s technology, except as generally and ordinarily permitted through the Site according to the Terms.

III. Registration and Account Security

To use the Services you must (i) be at least eighteen (18) years of age; (ii) have not previously been suspended or removed from the Services; and (iii) register for and use the Services in compliance with any and all applicable laws and regulations.

a) Account Registration. To access some features of the Services, you may be required to register for an account. When you register for an account, we may ask you to give us certain identifying information about yourself, including but not limited to your email address and other contact information, and to create a user name and password (“Registration Information”). When registering for and maintaining an account, you agree to provide true, accurate, current, and complete information about yourself. You also agree not to impersonate anyone, misrepresent any affiliation with anyone else, use false information, or otherwise conceal your identity from Wayshaping for any purpose.

b) You Are Responsible For Your Account. You are solely responsible for maintaining the confidentiality and security of your password and other Registration Information. For your protection and the protection of other users, we ask you not to share your Registration Information with anyone else. If you do share this information with anyone, we will consider their activities to have been authorized by you. If you have reason to believe that your account is no longer secure, you must immediately notify us at help@wayshaping.com.

IV. Specific Requirements for Certain Services

Your use of the Services constitutes your acknowledgment and acceptance of the following specific requirements and terms of use for certain of the Wayshaping Services.

A. Comments and Forums

Wayshaping may offer features that allow users to share content, comments and opinions on articles or topics with other users (collectively, “Comments”). Your use of the Comments is governed by the Terms.

  1. Content in Comments are the contributions of independent users not affiliated with Wayshaping, whose opinions are their own. Wayshaping does not guarantee the accuracy, integrity or quality of the opinions and advice posted on the Forum. Your use of any user content provided in the Comments is at your own risk.
  2. Wayshaping may, but is not required to, monitor Comments content and reserves the right to edit, correct or delete any Comments content for any reason at our sole discretion.
  3. You hereby grant to Wayshaping a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, translate, transmit, display, perform and distribute any content, information or material you submit or post to the Comments, in any medium now in existence or hereafter developed, for any purpose, including commercial uses. You waive all moral rights and similar rights you may have in such content, information and material. 
  4. We may terminate a user’s access or ability to use the Comments, immediately, without notice, and at our sole discretion, for the user's failure to comply with any terms or conditions of the Terms or Community Guidelines.

B. Wayshaping Life Admin Services

Wayshaping Life Admin Services provides administrative services to individual customers (Clients) via ad hoc packages or regularized subscription plans. The services are designed to help Clients begin to assess their personal financial, medical, and organizational situation by looking at such things as goal-setting, budgeting, consumer spending, medical appointments, and other household administrative activities. Life admin services are provided through consultations with a non-licensed, non-credentialed coach.

In order to enroll in life admin services, Clients enter into a separate agreement for Wayshaping Life Admin Services that governs the relationship, called the “Client Agreement.” In the event of a conflict between these Terms of Service and the Client Agreement, the Client Agreement governs the Life Admin Services provided by Wayshaping.

V. Third-Party Services

A. Sharing Information With Third-Parties

To use some of the Services, you may need to provide information such as credit card numbers, bank account numbers, and other sensitive financial information (such as investments, income, expenses, investable assets, investing risk tolerance or other similar types of information), to third-parties. By using the Services, you agree that Wayshaping or its subcontractors may collect, store, and transfer such information on your behalf, and at your sole request. More information is available in our Privacy Policy. You agree that your decision to make available any sensitive or confidential information to third-parties is your sole responsibility and at your sole risk. Wayshaping has no control and makes no representations as to the use or disclosure of information provided to third-parties. You agree that these third-party services are not under Wayshaping’s control, and that Wayshaping is not responsible for any third-party’s use of your information.

B. Wayshaping Does Not Endorse Third-Parties

The Services may contain links to third-party websites and services. Wayshaping provides such links as a convenience, and does not control or endorse these websites and services. You acknowledge and agree that Wayshaping is not responsible for the legality, accuracy, or appropriateness of any content on third-party websites or services, and shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any such third-party websites or services.

VI. Prohibited Conduct

You agree not to:

  1. Use the Services for any illegal purpose, or in violation of any local, state, national, or international law;
  2. Violate or misappropriate or encourage others to violate or misappropriate the rights of third-parties, including intellectual property rights;
  3. Post, upload, or distribute any content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could deem to be objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or otherwise inappropriate;
  4. Interfere in any way with security-related features of the Services or the Site;
  5. Interfere with the operation or any user’s enjoyment of the Services, including by uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code, making unsolicited offers or advertisements to other users, or attempting to collect personal information about users or third-parties without their consent;
  6. Access, monitor or copy any content or information of the Site using any robot, scripts, spider, scraper, or other automated means or for any purpose or any manual process to collect information or content, or use the Services as part of any machine learning or similar algorithmic activity without Wayshaping’s express written permission;
  7. Perform any fraudulent activity, including impersonating any person or entity, claiming false affiliations, accessing the accounts of other users without permission, or falsifying your identity or any information about you, including age or date of birth;
  8. Copy, reproduce, rent, lease, sell, transfer, assign, sublicense, modify, publish, disclose, distribute, display or prepare derivative works of the Services;
  9. Except to the extent permitted by applicable law and except to the extent expressly permitted in these Terms, reverse engineer, disassemble, or decompile the Services, including any corresponding source code, without prior written consent from us; or
  10. Sell or otherwise transfer the access granted herein.

VII. Intellectual Property and User Content. 

You hereby grant to Wayshaping a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, translate, transmit, display, perform and distribute any content, information or material you submit or post in connection with the Services or otherwise make available to Wayshaping or its subcontractors in connection with your use of the Services (“User Content”) for the following purposes: (a) with respect to User Content which is governed by our Privacy Policy, to provide you with the Services and comply with our obligations under the Terms, any other purposes set forth in the Privacy Policy, (b) with respect to User Content which is not governed by our Privacy Policy, including any feedback you may provide us about our Services, for any purpose, and (c) with respect to all User Content, to de-identify the User Content (if it constitutes personal information). All right, title and interest in and to such de-identified User Content created by or on behalf of Wayshaping shall be solely and exclusively owned by Wayshaping and Wayshaping may use it for any purpose. 

VIII. Payment Terms.

If you purchase any Service through the Site, you agree to pay any fees set forth at check-out. We utilize a third party (“Payment Provider”) to process payments. You must provide our Payment Provider with a valid credit card as a condition to such transactions. The Payment Provider’s policies govern the processing of your payment, and you must refer to those policies and not these Terms to determine your rights and liabilities. By providing your credit card number and associated payment information through the Site and Service, you authorize us through our Payment Provider to immediately invoice you for all fees and charges due and payable to us hereunder, and you agree that no additional notice or consent is required. We reserve the right at any time to change our payment terms, either immediately upon posting on the Site, by email delivery to you or any other reasonable method of communication.

IX. Taxes

If fees are subject to Sales Tax in any jurisdiction, you will be responsible for payment of such Sales Tax, and any related penalties or interest and will indemnify us for any liability or expense we may incur in connection with such Sales Taxes. For purposes of these Terms, “Sales Tax” will mean any sales or use tax, and any other tax measured by sales proceeds, that we are permitted to pass to you that is (a) the functional equivalent of a sales tax and (b) the applicable taxing jurisdiction does not otherwise impose a sales or use tax. We may automatically charge and withhold such taxes within any jurisdictions that it deems is required.

X. Indemnification

You agree that you will be personally responsible for your use of the Services, and you agree to defend, indemnify, and hold harmless Wayshaping and its former and current employees, contractors, directors, officers and contractors from and against any and all claims, liabilities, damages, losses, and expenses (including attorneys’ and accounting fees and costs), arising out of or in any way connected with (i) any content you have submitted to or through the Services; (ii) your violation of the Terms or any applicable law or regulation; (iii) your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right; or (iv) any disputes or issues between you and any third-party. Wayshaping reserves the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defense of such claim.

XI. Termination

If you violate the Terms, your permission to use the Services will automatically terminate. In addition, Wayshaping in its sole discretion may suspend or terminate your user account and/or suspend or terminate some or all of your access to the Services at any time, with or without notice to you. You may terminate your account at any time by contacting Customer Service at help@wayshaping.com. After your account is terminated, information and content previously provided by you will no longer be accessible through your account, but Wayshaping may continue to store such information and content, and it may also be stored by third-parties to whom it has been transferred through your use of the Services.

XII. Modification of the Terms.

Wayshaping may modify the Terms and impose new or additional terms or conditions on any use of the Services. If we do so, we will notify you by revising the date at the term of the Terms and/or in some cases (including where required by law) we may provide you with an additional notice, such as via email to the email address you have provided. Such modifications and additional terms and conditions will be effective immediately upon notice and incorporated into the Terms. Your continued use of the Services will constitute your acceptance of the modified terms and any applicable new or additional terms or conditions. If you do not agree to the modified terms or new or additional terms or conditions, you must stop using the Services, and if applicable, close your Wayshaping accounts. 

XIII. Disclaimers of Warranties

The disclaimers and limitations on our liability in this section apply to the fullest extent permitted by applicable law. The services are provided “as is” and on an “as available” basis, without warranty or condition of any kind, either express or implied. Although Wayshaping seeks to maintain safe, secure, accurate, and well-functioning services, we cannot guarantee the continuous operation of or access to our services, and there may at times be inadvertent technical or factual errors or inaccuracies.

A. No warranties

Wayshaping specifically (but without limitation) disclaims (i) any implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, or non-infringement; and (ii) any warranties arising out of course-of-dealing, usage, or trade. you assume all risk for any/all damages that may result from your use of or access to the services. Wayshaping is not responsible for the loss of, damage to, or unavailability of any information you have made available through the services, and you are solely responsible for ensuring that you have backup copies of any information you have made available through the services.

B. No Guarantee of Accuracy

Wayshaping does not guarantee the accuracy of, and disclaims all liability for, any errors or other inaccuracies in the information, content, recommendations, and materials made available through the services.

C. Services provided for Informational Purposes

The information provided through the services is provided solely for informational, educational, or entertainment purposes and does not constitute legal, financial, tax planning, medical, or other advice. Wayshaping and the services are not endorsed by or affiliated with FINRA, and Wayshaping is not a financial institution or insurance provider. Wayshaping makes no representations, warranties, or guarantees, express or implied, regarding the results or savings that may be obtained through the use of the services. 

Before making any financial decisions or implementing any financial strategy, including recommendations of third-parties identified through the services or Wayshaping Life Admin Services consultations, Wayshaping recommends that you obtain additional information and advice from accountants or other financial advisors who are fully aware of your individual circumstances. You agree that you are responsible for your own financial research and financial decisions, and that Wayshaping is not responsible or liable for any decisions or actions you take or authorize third-parties to take on your behalf based on information you receive as a user of Wayshaping.

D. No warranties regarding third-parties

Wayshaping makes no representations, warranties, or guarantees, express or implied, regarding any third-party service or advice provided by a third-party, or any quotes or offers provided through the services. Wayshaping does not endorse any particular advisor or other third-party. Wayshaping acts solely as an intermediary between you and third-party service providers and expressly disclaims any and all liability for any content, products, or services provided by such service providers.

XIX. Limitation of liability.

To the fullest extent permitted by applicable law: (a) in no event will Wayshaping or its officers, employees, service providers or representatives be liable to you for any incidental, special, consequential, indirect, or punitive damages, or for loss of profits, revenue, data or use, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, whether or not Wayshaping has been informed of the possibility of such damage, and (b) to the extent our liability has not already been excluded in the foregoing, in no event shall our cumulative liability to you, whether in contract, tort, or otherwise, exceed the greater of what you paid us for the applicable services (if any) and us $100.

XX. Governing Law.

The Terms are governed by the laws of the State of Pennsylvania, without regard to conflict of law principles. To the extent that any lawsuit or court proceeding is permitted hereunder, you and Wayshaping agree to submit to the exclusive personal jurisdiction of the state courts and federal courts located within Philadelphia, Pennsylvania, for the purpose of litigating all such disputes. We make no representation that information and materials included in the Services are appropriate or available for use outside the U.S.

XXI. Modification of the Services.

Wayshaping reserves the right to modify or discontinue, temporarily or permanently, some or all of the Services at any time without any notice or further obligation to you. You agree that Wayshaping will not be liable to you or to any third-party for any modification, suspension, or discontinuance of any of the Services.

XXII. General.

A. Entire Agreement.

Except as specified herein, these Terms, together with the Privacy Policy, constitute the entire and exclusive understanding and agreement between you and Wayshaping regarding your use of and access to the Services, and except as expressly permitted above may only be amended by a written agreement signed by authorized representatives of the parties.

B. No Waiver.

The failure to require performance of any provision shall not affect our right to require performance at any time thereafter, nor shall a waiver of any breach or default of the Terms constitute a waiver of any subsequent breach or default or a waiver of the provision itself.

C. Severability.

In the event that any part of the Terms is held to be invalid or unenforceable, the unenforceable part shall be given effect to the greatest extent possible and the remaining parts will remain in full force and effect.

D. Partner Terms.

In some instances, Wayshaping’s third-party partners require that Wayshaping’s users agree to be bound by some additional terms of use that are specific to particular products or services (“Partner Terms”). In the event of any conflict between the Partner Terms and Wayshaping’s Terms, Wayshaping’s Terms govern and control.

Privacy Policy

You should understand how we use your personal data and the choices you can make about that.

Introduction and Overview

When you use the websites and applications owned by Wayshaping (“Wayshaping,” “we,” “our,” “us”) and input your Personal Information, we have an obligation to provide you with clarity regarding how your data is accessed and used by Wayshaping, its affiliates, vendors, partners and other third-party entities.

To that end, this Privacy Policy describes the information we collect about you, how we collect it, how we use your information, whom we disclose your information to, and the steps we take to protect your information.

What This Privacy Policy Covers

This Privacy Policy describes our privacy practices related to your access and use of Wayshaping.com.

  • Wayshaping Platform. When we say “Wayshaping Platform” or “Platform,” this means the products and services that are made available and directly provided by Wayshaping. This includes, for example, our digital content, newsletter, authenticated application holding user information, and our arrangement to share your information or receive information from unaffiliated third-party partners with your consent. When we share your information with our unaffiliated third-party partners, their privacy policy may apply.
  • Wayshaping Services. When we say “Wayshaping Services” or “Services” this means the managed services provided in offline sessions.

We encourage you to read the entire Privacy Policy. By becoming a Wayshaping member or using the Wayshaping Platform and Services, you acknowledge that you have read and agree to the Privacy Policy. Your use of the Wayshaping Platform and Services is subject to the Wayshaping Terms of Use. We will let you know in this Privacy Policy if we have a new or different definition of a term.

Privacy Notice

Information We Collect

When we say “Personal Information,” we use this as a general term to mean information that can be any information about an individual from which that person can be reasonably identified. 

Information we collect directly from you

We may collect Personal Information directly from you when you use the Wayshaping Platform and Services — for example, when you register to become a member, subscribe to a newsletter form field, or fill out calculators or other form fields.

Here are the types of Personal Information we may collect:

  • Contact and registration information. Information you provide when you sign up to become a member, activate a subscription or upload information into the Wayshaping Platform or Service including your name, title and honorifics, email address, mailing address, phone number, date of birth, username and password. 
  • Classification information. Information to classify your life situation, including date of birth, current age range, marital status, gender, age of planned retirement, approximate net worth, or other similar demographic information.
  • Descriptive financial information. Information that describes, in non-specific terms, your financial situation, such as estimated debt, total investable assets, assets, financial goals, expenses, budgets, and other similar types of information about your job or business.
  • User-generated content information. When you communicate with us, either by email, phone, or other means of communication, we also may collect the content of these communications, including but not limited to recordings of phone calls where permitted by law.
  • Device and contact data. Depending on the permissions you grant in your device settings, we may get access to certain device-related information (e.g., device information, device identifiers).
  • Inferences about customer preferences and characteristics. We may infer from information provided by you, information collected directly from your browser or device, or from information obtained from third-party marketing database partners.

Information collected from third parties 

When you use Wayshaping Platform or Services, we may also obtain information about you from unaffiliated third-parties, such as our business partners, referral partners or advertisers when you authorize these parties to do so. The information we collect depends on the type of third-party and what you authorize them to share with us. For example, we collect Personal Information from:

  • Social media, email, and content providers. If you log onto your Wayshaping account through a social media site, we have access to certain information from that site, including your name, account information, profile photo. If you interact with content on our social media profiles (for example, if you “like” or share a blog or article from our website on Facebook, Instagram or other social media sites), those sites may share information about you with us depending on your privacy settings on those sites. Additionally, if you post information on a social media platform or another third-party service that references the Wayshaping Platform or Services, we may publish your post on our social media accounts or websites. To learn more about the privacy practices of the social media sites, please review the privacy notice of that site. 
  • Public information. We may collect Personal Information about you from publicly available sources, such as open government databases, real property recorder records, assessor records, and social media platforms (as explained above) and others. 

When we combine or associate information from other sources with your Personal Information that we collect through the Wayshaping Platform or Services, we will treat the combined information in accordance with this Privacy Policy, the Terms, and applicable law.

Information automatically collected

When you interact with us, use the Wayshaping Platform and Services, or open an email from Wayshaping, we may automatically receive and record certain information from your computer, web browser and/or mobile device.

Here are the types of data that we automatically collect:

  • Usage information. We collect information about your usage of Wayshaping Platform and Services, including the web pages or sites that you visit just before or just after visiting the website and applications, pages you view; your actions on the website and mobile applications, including the electronic path you take to, through and when exiting our websites and mobile applications, as well as your usage and activity on our website and applications, such as the links and objects you view, click or otherwise interact with (also known as “Clickstream Data”); and dates and times that you visit, access, or use the Wayshaping Platform and Services. 
  • Location information. The Wayshaping Platform and Services may collect your geolocation data, including when you access our websites on a mobile device. 
  • Device information. Information regarding the device you use when you interact with Wayshaping Platform and Services, including your IP address or other device address or ID, web browser and/or device type, and hardware and software settings and configurations.

Cookies and Tracking Technology

When you use or visit the Wayshaping Services and Platform, we may send one or more cookies or and similar tracking technologies.

Cookies are text files, containing small amounts of information, which are downloaded to your device as you browse the web or use a web-enabled app.

There are two broad categories of cookies:

  • First party cookies, served directly by us to your computer or mobile device when you use a web-enabled app. 
  • Third-party cookies, which are served by a third-party on our behalf. We use third-party cookies for functionality, analytics, marketing, and social media purposes.

As explained below, cookies can remain on your computer or mobile device for different periods of time:

  • Single-session (temporary) cookies. Temporary cookies last only as long as your web browser is open and are used for technical purposes such as enabling better navigation on our Website. Once you close your browser, the cookie disappears.  
  • Multi-session (persistent). Persistent cookies are stored on your computer or device for longer periods and are used for purposes including session management (for example, to recognize you and recall your individual login information and preferences).

Like most services, we generally use cookies to track the number of unique visitors and information such as the number of view a page gets, how much time a user spends on a page and other web statistics; monitor the performance of our Wayshaping Platform and Services and to continually improve it; and customize and enhance your online experience.

We classify cookies in the following categories:

  • Non-targeting cookies. These cookies are primarily used for operational, performance/analytical, and functional purposes. Combined, these cookies assist us with providing you with services available through the Wayshaping Services and Platform and to use some of the available features. 
  • Targeting cookies. These cookies may be set through our Wayshaping Services and Platform by our advertising partners. They may be used by those companies to build a profile of your interests and show you relevant adverts on other sites. They do not store directly Personal Information, but are based on uniquely identifying your browser and internet device. If you do not allow these cookies, you will experience less targeted advertising.

How to control or delete cookies

Most browsers also allow you to adjust your cookie settings. These settings will typically be found in the “options” or “preferences” menu of your browser. In order to adjust these settings, please consult the “Help” function of your browser, or the documentation published online for your particular browser type and version. For residents of certain jurisdictions, you may be able to adjust your cookie settings by visiting our cookie preferences center.

Third-party web beacons and third-party buttons

We may implement third-party advertising or other content on the Wayshaping Services or Platform that may use clear GIFs or other forms of web beacons, which allow the third-party content provider to read and write Cookies to your web browser in connection with your viewing of the third-party content on the Wayshaping Services or Platform. Additionally, we may implement third-party buttons (such as Facebook “like” or “share” buttons) that may allow a third-party to collect information about you through their browser Cookies, even when you do not interact with the button.

We also engage third-party partners and vendors like Google Analytics, Segment, Outseta, and others, who provide analytics and advertising services, to assist us in providing you the Wayshaping Services or Platform. We allow these third-parties, including unaffiliated business partners, advertising networks, analytics providers, and other advertising service providers, to automatically collect Clickstream Data and other information about your online activities on the Wayshaping Services or Platform and across your browsers and devices using cookies, web beacons, mobile advertising identifiers and other technologies. We use this data for our own analytics and advertising purposes, as well as to facilitate partner relationships and your interactions with other third-parties. In addition, certain of our third-party partners may use this information to display online advertisements tailored to your interests and preferences across your browsers and devices, to conduct ad campaign measurement and website analytics, to detect, prevent and report fraud, or to carry out their own business and commercial purposes.

Where information collected through web beacons, buttons, and similar technologies is collected directly by third-parties, their collection and use of information is subject to that third-party’s own privacy policies. You may opt out of the use of Google Analytics Cookies using Google Analytics opt-out tool.

Due to differences between using websites and apps on mobile devices, you may need to take additional steps to opt out on both platforms. Many mobile devices allow you to opt out of interest-based advertising for mobile apps using the settings within the mobile app or your mobile device. For more information, please check your mobile device settings. You also may uninstall our app using the standard uninstall process available on your mobile device or app marketplace. Please note that your opt-out choice will apply only to the browser and device you are using when you opt out.

How We Use Your Information

Your information is an integral part of our operations, and we use it in a variety of ways in providing the Wayshaping Platform and Services and in operating our business. We use your Personal Information to:

  • Provide you the services you request. 
  • Enable provision of the Wayshaping Platform and Services to you.
  • Verify your identity and administer your User Account.
  • Communicate with you, including customer support, security alerts, or recommend and offer financial products or services offered by our unaffiliated third-party partners.
  • Communicate with you about other things we think you will be interested in, such as newsletters, surveys, contests or sweepstakes, events or announcements.
  • Operate, maintain and improve the Wayshaping Services and create new features and functionality.
  • Understand and analyze usage trends and preferences of our users across different devices.
  • Enhance and protect the safety, integrity, and security of the Wayshaping Platform and Services, including prevention of fraud and other unauthorized or illegal activities and information security.
  • Personalize, contextualize and market the Wayshaping Services to you.
  • Enforce, investigate, and report conduct violating our Terms or other policies. 
  • Protect or exercise our legal rights or defend against legal claims, including to enforce and carry out contracts and agreements. 
  • Comply with applicable laws, licensing, and regulatory obligations. address intellectual property, right of privacy or defamation issues related to content you have posted on the Wayshaping Platform and Services, and/or (c) send you promotional materials, offers, and/or messages related to the Wayshaping Platform and Services and the activities of third-parties we work with. Generally, you can opt out of receiving promotional communications, through links provided in the messages, by updating your account preferences through your Wayshaping profile.
  • With your consent. We may use your email address or other Personal Information to (a) contact you for administrative purposes such as customer service, (b) account, or by contacting us directly at help@wayshaping.com.
  • We may use cookies and automatically collected information, as described above, to: (a) personalize our services, such as remembering your information so that you will not have to re-enter it during your visit or the next time you visit the Wayshaping Platform or Services; (b) pre-fill forms; (c) provide customized advertisements, content, and information across your devices; (d) monitor and analyze the effectiveness of Wayshaping Platform or Services and third-party marketing activities; (e) monitor aggregate site usage metrics such as total number of visitors and pages viewed; and (f) track your entries, submissions, and status in any promotions or other activities.
  • For any other purpose disclosed by us when you provide the information or with your consent.

How We Disclose Your Information

We disclose your information to unaffiliated third-parties in the following circumstances depending on how you interact with Wayshaping Platform and Services.

  • To verify your identity in connection with your use of the Wayshaping Platform and Services and the operation of our business. For example, we may disclose Personal Information, such as name, email, address, date of birth, and other identifying information, to third-party service providers to verify your identity in connection with your use of certain aspects of the Wayshaping Platform and Services.
  • To prepare customized offers of third-party products or services for you. We may disclose information collected directly from you to unaffiliated third-party partners in connection with your use of specific aspects of the Services. Some examples include but are not limited to:some text

  • With wholly-owned subsidiaries. We may disclose your credit report and other Personal Information to and/or among our wholly-owned Wayshaping subsidiaries in order to provide you with recommendations on financial products and services that might be of interest to you.
  • With service providers. We may disclose your information to third-party service providers to support our internal and business operations. In such cases, service providers may use the information only as necessary to provide the services to us and are contractually required to keep your information confidential and secure. They are required to implement reasonable privacy and information protection controls to maintain the privacy and security of information provided to them consistent with the privacy practices outlined in this Privacy Policy. Additionally, questions you submit and answers provided by third-parties may be posted on Wayshaping Services and viewable by other users and the public.
  • For advertising and analytics. We may disclose de-identified and/or aggregate analytics to third-party partners about how users interact with the Wayshaping Services and Platform, including usage patterns for certain programs, content, services, advertisements, promotions, and/or functionality available through the Wayshaping Services and Platform.
  • For legal reasons. We may disclose your information if required to do so by law or in the good-faith belief that such action is necessary to comply with state and federal laws (such as copyright law), in response to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement activity.
  • For mergers and acquisitions. We may take part in or be involved with a corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of company assets. We may disclose Personal Information to a third-party during negotiations of, in connection with or as an asset in such a corporate business transaction.   • With your consent. If you request a product or more information about a product or offering, you consent to the disclosure of your information to third-parties in order for us to carry out your request. Wayshaping has no control over the means by which third-parties further use or disclose your information.

If you submit a request through the Wayshaping Platform, a third-party service provider may directly contact you with quotes or information via telephone, auto-dialed pre-recorded calls, SMS, direct or instant message, fax, and/or email.

Do not submit a request for information or services if you do not want your Personal Information disclosed as described above. Once you have submitted a request and we have disclosed your information as described above, the terms of the third-party’s privacy policy will apply to that party’s use of your information. You may, of course, decline to share certain information with us, in which case we may not be able to provide to you some of the features and functionality of the Wayshaping Services.

Third-Party Websites

Our websites, Platform, and Services may contain links to third-party websites, which may have privacy policies that differ from our own. You should be aware that the collection, retention and use of any data you provide on these websites, including Third-Party Products Sites, will be governed by the privacy policy of the company providing the website and not by this Privacy Policy. Wayshaping therefore encourages you to read the privacy policies and terms and conditions of linked or referenced websites you enter. These third-party websites may send their own cookies and other tracking devices to you, log your IP address, and otherwise collect data or solicit Personal Information.

WAYSHAPING DOES NOT CONTROL AND IS NOT RESPONSIBLE FOR WHAT THIRD-PARTIES DO IN CONNECTION WITH THEIR WEBSITES, OR HOW THEY HANDLE YOUR PERSONAL INFORMATION. PLEASE EXERCISE CAUTION AND CONSULT THE PRIVACY POLICIES POSTED ON EACH THIRD-PARTY WEBSITE FOR FURTHER INFORMATION.

How Long We Retain Your Personal Information

Wayshaping may retain your Personal Information for as long as is necessary to carry out the purposes set out in this Privacy Policy or as otherwise required or permitted by applicable law.

When determining the retention period, we take into account various criteria, such as the nature of the use of our Platform and Services, your general relationship with us, the impact on our ability to provide you our Platform and Services if we delete your Personal Information, mandatory retention periods provided by law and the statute of limitations, and our use of your Personal Information for aggregated market research.

If you no longer want Wayshaping to use your information to provide the Wayshaping Platform and Services to you, you may close your account. Although your deactivated status is reflected promptly in our user databases, we may retain the information you submit for a variety of purposes, including legal compliance, backups and archiving, prevention of fraud and abuse, and analytics. Upon deactivation, you will no longer receive emails from us and links to third-party financial accounts, and services will automatically terminate. If your account is canceled because you’ve not used it in a long time, we may delete this information at any time. There may be occasions where we are unable to fully delete, anonymize, or de-identify your information due to technical, legal, regulatory compliance or other operational reasons. Where this is the case, we will take reasonable measures to securely isolate your Personal Information from any further processing until such time as we are able to delete, anonymize, or de-identify it.

Verification

To help protect your privacy and secure your Personal Information, you may be asked to provide additional information to verify your identity and/or ownership rights prior to us exercising your data rights. Updating your information

Once you have registered for a Wayshpaing account, you may update or correct your profile information and preferences at any time by accessing your Profile Settings.

Deactivating your account

We do not delete information about you upon deactivation of your account. Although your deactivated status is reflected promptly in our user databases, we may retain the information you submit for a variety of purposes, including legal compliance, backups and archiving, prevention of fraud and abuse, and analytics. Upon deactivation, you will no longer receive emails from us and links to third-party financial accounts, and services will automatically terminate.

Unsubscribing and managing communications from us

How to unsubscribe from email communications

If you do not wish to receive email offers or newsletters from us, you can opt out of receiving emails from us (except for emails related to the completion of your registration, correction of user data, change of password, and other similar communications essential to your transactions through the Services) by using the unsubscribe process at the bottom of any marketing email from us. Although your changes are reflected promptly in active user databases, we may retain all information you submit for a variety of purposes, including backups and archiving, prevention of fraud and abuse, and analytics.

How to unsubscribe from SMS communications

We may provide our registered Wayshaping customers with SMS alerts regarding their activity on the Service. Registered customers have the ability to opt out of receiving these SMS alerts.

Data Security

We use certain physical, managerial, and technical safeguards that are designed to protect the integrity and security of your information. We cannot, however, ensure or warrant the security of any information you share or store with us through the Wayshaping Platform and Services, and you do so at your own risk.

Protecting your Personal Information is also your responsibility. Be mindful of keeping your password and other authentication information safe from third-parties, and immediately notify us of any unauthorized use of your login credentials.

Children

Wayshaping Platform and Services are intended for use by general audiences and are not targeted directly at children under 16.

Children under the age of 16 are not permitted to use the Wayshaping Platform or Services, and we do not seek or knowingly collect any Personal Information about children under 16 years of age. If we become aware that we have unknowingly collected information about a child under 16 years of age, we will make commercially reasonable efforts to delete such information from our database. If you are the parent or guardian of a child under 16 years of age who has provided us with their Personal Information, you may contact us at help@wayshaping.com to request that it be deleted.

Changes and Updates to This Privacy Policy

We reserve the right to make changes to this Privacy Policy at any time. Any changes will be effective immediately upon the posting of the updated Privacy Policy, or such later date as may be specified in the updated Privacy Policy. We will notify you about material changes in the way we treat your information, such as by placing a prominent notice on the Wayshaping Platform and Services or by sending you an email so that you can choose whether to continue using the Wayshaping Platform and Services.

Services Agreement

Key Provisions

By signing the Services Agreement, you are representing and agreeing that you have read each carefully and understood their terms. You should not sign the Services Agreement if you have any questions about your obligations under the Agreements, the services that Wayshaping is agreeing to provide, or the limitations of those services.

If you do have questions, please email help@wayshaping.com prior to signing the Agreements. You should retain these Agreements for future reference.

Client understands that confirming or clicking to indicate you agree is the legal equivalent of manually signing the Agreements, and Client will be legally bound by their terms and conditions, including the arbitration clause included in the common provisions. Client understands that the Agreements may be amended from time to time pursuant to the amendment provisions provided therein. Client understands that by affirmatively accepting the amendment, or by not closing and/or by continuing to use the client's accounts after the effective date or time of the amendment, client is accepting the terms of the revised Agreements and will be legally bound by their terms and conditions.

Definitions

The following definitions apply in the Agreement:

  1. Service(s). Personal administrative services where personally identifiable and sensitive information may be, without intention, witnessed, available, or shared.
  2. Interface. Applications and websites maintained by Wayshaping.
  3. Account. The client's

Use of Wayshaping's Content

Client is permitted to store, display, analyze, modify, reformat, and/or print the information made available by Wayshaping for personal use only. Client will not publish, transmit, or otherwise reproduce this information, in whole or in part, in any format to any third party without the express written consent of Wayshaping. Client will not alter, obscure or remove any copyright, trademark, or any other notices that are provided in connection with the information. Client represents and warrants that:

  • Client will not use the Interface in contravention of Client Agreement;
  • Client will use the Interface only for the benefit of the Account and not on behalf of any other person;
  • with the exception of a web browser and other applications specifically approved by Wayshaping in writing, Client agrees not to use (or allow another person to use) any software, program, application, or other device, directly or indirectly, to accessor obtain information through the Interface or to automate the process of accessing or obtaining such information.

Services Agreement

CLIENT UNDERSTANDS THAT THIS SERVICES AGREEMENT MAY BE AMENDED FROM TIME TO TIME BY WAYSHAPING AND THAT WAYSHAPING WILL PROVIDE CLIENT WITH ADVANCE NOTICE OF MATERIAL CHANGES VIA EMAIL OR OTHER WRITTEN COMMUNICATION PURSUANT TO THE AMENDMENT SECTION OF THIS AGREEMENT. CLIENT UNDERSTANDS THAT BY AFFIRMATIVELY ACCEPTING THE AMENDMENT, OR BY NOT CLOSING AND/OR BY CONTINUING TO USE CLIENT'S ACCOUNT AFTER THE EFFECTIVE DATE OR TIME OF THE AMENDMENT, CLIENT IS ACCEPTING THE TERMS OF THE REVISED ADVISORY AGREEMENT AND WILL BE LEGALLY BOUND BY ITS TERMS AND CONDITIONS.

Introduction

Client understands and agrees that this Services Agreement govern all aspects of Client’s relationship with Wayshaping, including all products and services now or in the future offered through Wayshaping, beginning on the date Client begins receiving services from Wayshaping. Wayshaping reserves the right to modify or terminate this Services Agreement at anytime.

Up-to-date information about the service contemplated by this Services Agreement will be provided via the Website. Client agrees to consult the Services Agreement information on the Website regularly. If Client is unwilling to be bound by the terms and conditions of this Services Agreement, Client will not open an Account and/or participate in the Program. Wayshaping reserves the right to terminate any Account at any time and for any reason, in its sole discretion.

Scope of Services

Wayshaping agrees to provide the services described in this Services Agreement, and this Section in particular, on the terms and conditions described herein.

Wayshaping life admin services are one-on-one coaching services where educational information is shared with participating clients. The services are a partnership between Wayshaping and the client to maximize personal potential. All actions taken are the sole responsibility of the client. Services do not constitute or include: investment advice, insurance recommendations, tax advice, medical advice, psychotherapy, or financial planning.

Client acknowledges that all information provided in services are informational or educational purposes only, and all choices made in response to services, are the Client's sole responsibility.

Security and Reliability

Client acknowledges that the Internet is not a secure network and that communications transmitted over the Internet may be accessed by unauthorized or unintended third parties. E-mail notifications sent by Wayshaping will not contain sensitive or confidential customer information. Due to security risks, Client will not send any sensitive information, such as account numbers or Passwords, in an unencrypted e-mail.

Disclosure of Liability and Hold Harmless Agreement

Client understands and agrees that Wayshaping shall not be liable in any way to Client or to third parties, or have any responsibility whatsoever, and Client agrees to indemnify and hold harmless Wayshaping, its affiliates, and any independent providers, for any damages arising out of or relating to:

  1. A cause over which Wayshaping or its affiliates did not have direct control, including the failure of electronic or mechanical equipment or communication lines, telephone, or other interconnect problems, unauthorized access, theft, operator errors, government restrictions, force majeure (e.g., earthquake, flood, severe or extraordinary weather conditions, natural disasters or other act of God, fire, acts of war, terrorist attacks, insurrection, riot, strikes, labor disputes or similar problems, accident, action of government, communications, system or power failures and equipment or software malfunction), or exchange rulings;
  2. The participation of Wayshaping in the Service whereby the personal information of the Client is exchanged, witnessed, or otherwise accessible via an electronic service.

Community Guidelines

Wayshaping offers community features where users like you can comment and and engage with content.

When you sign up, you can post, comment, vote, and discuss life admin ideas with other users. Over time, Wayshaping will come to be defined by its users. Wayshaping's team currently acts as moderators.

Community rules

Rule 1

Be humane. W aims to create community and belonging, not an experience where people are attacked, marginalized, or bullied. Users that incite violence or that promote hate based on identity or vulnerability will be banned.

Rule 2

Abide by community rules. Post authentic content and do not cheat or engage in content manipulation (including spamming, vote manipulation, ban evasion, or subscriber fraud).

Rule 3

Respect the privacy of others. Instigating harassment, for example by revealing someone’s personal or confidential information, is not allowed. Never post or threaten to post intimate or sexually-explicit media of someone without their consent.

Rule 4

Do not share or encourage the sharing of sexual, abusive, or illegal content. Any predatory or inappropriate behavior involving a minor is also strictly prohibited.

Rule 5

You don’t have to use your real name on Wayshaping, but don’t impersonate an individual or an entity in a misleading or deceptive manner.

Rule 7

Do not attempt to solicit or sell anything on Wayshaping.

Rule 8

Don’t break the site or do anything that interferes with normal use of Wayshaping.

Enforcement

We have a variety of ways of enforcing our rules, including, but not limited to

  • Asking you nicely to stop
  • Asking you less nicely
  • Temporary or permanent suspension of accounts
  • Removal of you as a user
  • Removal of comments or other content
